A New Beginning: Ana and José’s Story
Ana and José García are the representation of perseverance and cross-border love. Originally from Guatemala, this couple came to the United States looking for a more promising future, bringing with them not only their belongings, but also their traditions, culture and, above all, their shared dreams.
However, like many immigrants, they encountered significant obstacles, especially regarding their legal status in the United States.
The Transformative Process: Adjustment of Status by Marriage
Ana and Jose’s marriage not only brought their lives together in an emotional and cultural sense, but also opened a door to legal stability in the US.
After getting married in the United States, they decided to undertake the adjustment of status process, a path that would allow them to obtain permanent residency(Green Card) based on their marriage.
“We knew we wanted to build our life here, together and without fear. Adjustment of status by marriage was our ray of hope,” Ana recalls.
Navigating the Status Adjustment Process
The couple initially faced a bewildering tangle of paperwork and requirements. The process involved the filing of multiple forms, including Form I-130 (Petition for Alien Relative) by Jose, who already had legal status in the U.S., and Form I-485 (Application to Register Permanent Residence or Adjust Status) by Ana.
The necessary documentation was extensive and required evidence of their legitimate marriage, such as marriage certificates, photos together, joint bank accounts, and testimonials from friends and family. In addition, the couple had to prepare for a personal interview with an immigration officer designed to verify the authenticity of their relationship.
Development and End of Events
After months of preparation, documentation and anxious waiting, the interview came. Ana and Jose, with the help of an immigration attorney and the unconditional support of the Guatemalan consulate, were able to successfully prove the veracity of their marriage. Approval of his adjustment of status came a few weeks later, a moment Jose describes as:
“Not only a victory for us as a couple, but an affirmation of our rights to pursue happiness and security.”
Today, Ana and José are enjoying life in the USA. with the peace of mind that comes with their new permanent resident status. They have started a small business together, contributing to their community and local economy, and plan to apply for U.S. citizenship as soon as they are eligible.
